Auraly Terms and Conditions

Auraly is a mobile and web application that provides AI-generated astrology, numerology, and symbolic self-reflection content — including personalized horoscopes, natal chart interpretations, compatibility insights, and related reports — designed to help users explore self-understanding and personal growth (the "Services"). Auraly is operated by Appyon Software & Wellness, LLC ("Auraly," "Appyon," "we," "us," or "our").

These Terms of Use ("Terms," "Agreement") govern your access to and use of the Auraly website, mobile application, and any related features, content, and services (collectively, the "Platform"). By creating an account, purchasing a subscription, or otherwise using the Platform, you ("User," "you," "your") agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, you must not access or use the Platform.

You must be at least 18 years old, or the age of legal majority in your jurisdiction if higher, to use the Services. By using Auraly, you represent and warrant that you meet this requirement. We may request age verification at our discretion and may suspend or terminate accounts where eligibility cannot be confirmed.

• "Services" means the AI-generated astrology, numerology, and wellness content, reports, and features made available through the Platform.
• "Subscription" means a recurring paid plan granting access to premium features of the Services.
• "User Content" means any information, data, or input you submit to the Platform, including birth details, preferences, and responses to quiz/onboarding flows.
• "AI-Generated Content" means any horoscope, chart interpretation, report, or other output produced by automated/algorithmic or artificial intelligence systems based on your inputs.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 15 days before taking effect, unless a shorter period is required by an emergency, security, or legal necessity. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. If you do not agree to a material change, you may cancel your subscription before it takes effect.

Auraly is operated by Appyon Software & Wellness, LLC, a limited liability company registered in the United States (EIN: 30-1496969).

Auraly provides personalized digital experiences, powered by artificial intelligence and other computational technologies, designed to promote entertainment, self-discovery, personal reflection, mindfulness, curiosity, and wellness-oriented experiences.

The Services may generate personalized insights using information voluntarily provided by Users, including quiz/questionnaire responses, birth information, preferences, interactions, suggestions, and other inputs.

The Services may also use symbolic interpretation systems, artificial intelligence models, proprietary algorithms, statistical methods, personalization technologies, and other computational approaches to produce personalized digital experiences.

The Services may provide personalized digital content, including, without limitation:

• interactive conversations;
• personalized reports;
• visual experiences;
• compatibility experiences;
• educational content;
• recommendations;
• digital illustrations;
• symbolic interpretations;
• notifications;
• wellness-related content;
• self-reflection experiences;
• and other AI-generated outputs.

Not all users will receive identical responses, recommendations, or content. AI-generated outputs may vary over time, even when similar inputs are provided.

Auraly does not offer free functionality. Certain services are available only through paid Subscriptions, purchased either through the applicable app store (iOS/Android) or through our website. Subscription benefits may include access to premium AI experiences, additional personalized content, expanded usage limits, exclusive digital experiences, and future premium features. The exact features available within each subscription plan may change from time to time and are described within the app before purchase.

Credits for AI-Generated Personalized Content. Certain personalized outputs — including AI-generated readings and insights tailored to your specific inputs — are not included in the Subscription and must be purchased separately using credits. Credits are purchased as an in-app add-on, are priced and described before purchase, and are consumed when you request a personalized AI-generated reading or insight. Credits are non-refundable once used to generate content, except as described in Section 5.7.

We are continuously improving our Services. As a result, we may:

• introduce new features;
• discontinue existing features;
• modify functionality;
• change user interfaces;
• enhance AI models;
• update personalization systems;
• modify available subscription benefits;
• launch beta features;
• remove obsolete features.

We have no obligation to maintain any specific feature indefinitely.

We strive to provide uninterrupted access to the Services. However, availability is not guaranteed. The Services may be temporarily unavailable due to:

• maintenance;
• software updates;
• security measures;
• technical failures;
• third-party outages;
• force majeure events;
• infrastructure improvements;
• internet connectivity issues.

Many of the features available in Auraly rely on artificial intelligence systems. AI technologies generate responses probabilistically, based on patterns, algorithms, available information, and user inputs. As a result:

• responses may contain inaccuracies;
• results may be incomplete;
• interpretations may vary over time;
• similar inputs may generate different responses;
• AI-generated content should not be interpreted as objective fact.

AI systems continue to evolve and may occasionally produce unexpected or inaccurate outputs. AI-generated content is not verified by a human professional before being shown to you unless a specific feature states otherwise.

The Services are provided exclusively for:

• entertainment;
• self-discovery;
• personal reflection;
• educational purposes;
• mindfulness;
• curiosity;
• wellness-oriented experiences.

The Services are not intended to provide factual statements about any person's life, future, relationships, career, finances, health, or other real-world outcomes.

No psychic, divination, or fortune-telling services are offered. Auraly does not offer mediumship, divination, clairvoyance, supernatural predictions, or guaranteed forecasts of future events. Any symbolic interpretation, AI-generated reading, compatibility experience, illustration, recommendation, or personalized content is intended solely for entertainment and reflective exploration purposes. Nothing in the Services should be construed as a prediction of actual future events or a guarantee of any outcome.

Auraly does not predict, guarantee, or claim to foresee future events, outcomes, or circumstances in your life. Any language in the app that references "what's ahead," timing, or forecasts is descriptive and symbolic in nature and must not be relied upon as a factual prediction.

We make no representation or warranty that:

• any AI-generated content is accurate;
• any interpretation reflects reality;
• recommendations are correct;
• compatibility assessments are factual;
• personalized reports are scientifically validated;
• any desired outcome will occur.

The Services do not guarantee improvement in relationships, financial success, emotional well-being, compatibility, personal growth, or any other outcome. Our AI models are continuously trained and refined to improve over time, but they remain algorithmic systems that are inherently capable of producing incorrect, inconsistent, or nonsensical output. Interpretations may vary and are influenced by the underlying model, the data you provide, and the interpretive framework used. Results should be treated as perspectives, not facts.

Auraly is intended for entertainment, reflection, and self-discovery only. The Services do not constitute, and should not be relied upon as:

• medical advice;
• psychological advice;
• psychiatric advice;
• legal advice;
• financial advice;
• investment advice;
• tax advice;
• relationship counseling;
• therapeutic services;
• emergency assistance; or
• any other regulated professional service.

You should always consult appropriately qualified professionals regarding decisions involving your health, finances, legal matters, mental well-being, relationships, or other significant life decisions. Nothing in the Services should be used as the sole basis for such decisions.

You remain solely responsible for:

• your decisions;
• your actions;
• your interpretations;
• your relationships;
• your financial decisions;
• your legal decisions;
• your health decisions;
• and any consequences arising from your use of the Services.

You agree that you use the Services voluntarily and at your own discretion. The Company is not liable for decisions made based on AI-generated content, symbolic interpretations, personalized reports, recommendations, or any other information provided through the Services, including emotional responses to content or outcomes of any kind connected to your use of the app.

To use certain features, you must create an account with accurate information, including a valid email address. You are responsible for keeping your account information current.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@auralyapp.com if you suspect unauthorized access. We may use passwordless authentication, verification codes, or other security measures to protect your account.

You agree to use the Platform only for lawful purposes and in accordance with these Terms, and to provide accurate information (such as birth date/time) so that generated content functions as intended.

You must not: create multiple accounts to abuse trials or promotions; share account credentials; submit false or misleading information; attempt to reverse-engineer, scrape, or extract Auraly's underlying models, prompts, or algorithms; use the Services for any unlawful, harmful, or abusive purpose; or attempt to circumvent security or payment mechanisms.

We may suspend or terminate your account for violation of these Terms, fraudulent activity, chargeback abuse, or as required by law. Where practical, we will provide notice before termination, except where immediate action is necessary to prevent harm or comply with legal obligations.

Auraly offers standard Subscription plans billed monthly, quarterly, or annually, with recurring prices generally ranging from $29 to $99 per billing period, depending on the plan selected. The specific plan, price, and billing frequency applicable to you are shown before you subscribe and are also available in your account settings.

Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, unless you cancel before the renewal date. Your payment method on file will be charged automatically at renewal.

To let you explore the full functionality of the app before committing to the standard price, we offer a paid introductory trial period at a reduced price. Trial periods generally last 3, 5, 7, or 30 days, at prices generally ranging from $4 to $19, depending on the plan selected, and will be clearly disclosed before you complete your purchase. Unless canceled before the trial ends, your trial will automatically convert into a recurring Subscription at the standard price for your selected plan (see Section 5.1). Only one trial per user/payment method is permitted unless otherwise stated.

All prices are shown in your local currency where supported, or in USD otherwise, and include any applicable taxes required to be disclosed at checkout. Payments are processed by third-party payment processors (see Section 5.9). Your total charge will match what was displayed at the time of purchase.

If a renewal payment fails, we will attempt to retry the charge over a period of up to 30 days. During this period, your access to paid features may be interrupted while retries are attempted. If payment is not successfully processed within this 30-day period, your access will remain suspended and will not resume automatically — you will need to manually update your payment method and reactivate your Subscription to regain access.

You may cancel your Subscription at any time, free of charge, through one of the following methods:

• Self-service cancellation portal: Visit web.auralyapp.com/managepayments, enter the email address used for your purchase, and you will receive a confirmation code by email. Enter this code to access the portal and cancel your Subscription with one click.
• Support: Email contact@auralyapp.com with your account email and cancellation request.

If your Subscription was purchased through an app store (Apple App Store or Google Play), it must be canceled through that store's subscription management settings, as we do not have the ability to cancel app-store billing directly.

To avoid being charged for the next billing period, cancellation must be completed before the renewal date. Access to paid features continues until the end of the current paid period; no partial refunds are issued for unused time except as described in Section 5.7.

Our policy does not offer refunds. All purchases — including Subscriptions, trial charges, and credits — are final and non-refundable, except in exclusive cases reviewed and approved at the sole discretion of our support team. To request consideration of an exceptional refund, email contact@auralyapp.com with your account email, transaction details, and the reason for your request. Submitting a request does not guarantee that a refund will be granted. Approved refunds, when granted, are issued to the original payment method only.

We may change Subscription prices for new subscribers or upon renewal for existing subscribers, with notice provided in accordance with Section 1.5. Price changes will not apply retroactively to periods already paid.

Payments are processed securely by third-party payment providers (which may include Stripe and other PCI-DSS compliant processors) in compliance with applicable card network and data security standards. We do not store your full payment card details. Currency conversion, if applicable, is handled by your bank or card issuer and any related fees are outside our control.

All content, features, and functionality of the Platform — including the Auraly name, logo, design, software, AI prompting frameworks, and interpretive methodologies — are owned by Appyon Software & Wellness, LLC or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Platform or its content except as expressly permitted.

You retain ownership of the personal information you submit, including birth details, quiz responses, and any photos you choose to upload for AI-generated scenarios or visual content created for entertainment purposes. By submitting this information, you grant us a non-exclusive, worldwide, royalty-free license to use it solely to generate your personalized content, operate and improve the Services, and as otherwise described in our Privacy Policy. You represent that you have the right to upload any photo you submit, including that it depicts you or that you have the consent of the person depicted, and that it does not infringe any third party's rights.

Reports and content generated for you through the Services are provided for your personal use. We do not claim ownership over your personal reflections or use of the output, but the underlying prompts, models, and generation methodology remain our proprietary property.

If you provide feedback or suggestions about the Services, you grant us the right to use that feedback without restriction or obligation to you.

If you believe content on the Platform infringes your copyright, contact us at contact@auralyapp.com with details sufficient to identify the material and your claim.

"Auraly" and associated logos are trademarks of Appyon Software & Wellness, LLC. You may not use them without our prior written consent.

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Information you provide (birth details, quiz answers, usage data) is processed to generate your personalized content and to operate, maintain, and improve the Services, in accordance with our Privacy Policy and applicable data protection law.

The Services rely on third-party providers for functions such as payment processing, analytics, and infrastructure hosting. Use of these providers is subject to their own terms and privacy practices where applicable.

We may use analytics tools to understand usage patterns and improve the Services. Aggregated or de-identified data may be used for product improvement and research.

We implement reasonable technical and organizational measures to protect your information, but no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

If you are located in Brazil, or where otherwise applicable, the processing of your personal data is additionally subject to Brazil's Lei Geral de Proteção de Dados (Law No. 13,709/2018, "LGPD"). Certain data collected by the Services — including your birth date, birth time, birth location, and any photos uploaded for AI-generated scenarios — is used specifically to generate your personalized astrology, numerology, and entertainment content, and is processed on the basis of your consent, which you provide when you submit that information. Photos uploaded for AI-generated scenarios may involve the processing of biometric or image data and are treated with heightened care; we do not use uploaded photos for any purpose beyond generating the entertainment content you requested and improving the underlying generation systems, as described in our Privacy Policy. Under the LGPD, you have the right to confirm the existence of processing, access your data, correct incomplete or inaccurate data, request anonymization or deletion of unnecessary or excessive data, request portability, obtain information about data sharing, and withdraw your consent at any time. You may exercise these rights, or revoke consent for the use of any specific data (such as uploaded photos), by contacting us at contact@auralyapp.com.

THE SERVICES, INCLUDING ALL AI-GENERATED CONTENT, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE. NOTHING IN THIS SECTION LIMITS ANY RIGHTS YOU MAY HAVE UNDER MANDATORY CONSUMER PROTECTION LAWS IN YOUR JURISDICTION.

We aim to keep the Platform available but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability, with notice provided where practical.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPYON SOFTWARE & WELLNESS, LLC'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES RELATED TO PERSONAL, FINANCIAL, RELATIONSHIP, OR CAREER DECISIONS MADE IN CONNECTION WITH CONTENT RECEIVED THROUGH THE SERVICES.

You agree to indemnify and hold harmless Appyon Software & Wellness, LLC, its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the Services, or violation of applicable law.

We are not liable for delays or failures resulting from causes beyond our reasonable control, including natural disasters, government actions, internet or infrastructure failures, cyberattacks, or other similar events.

These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and Appyon Software & Wellness, LLC regarding the Services, superseding any prior agreements or understandings.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.

You may not assign or transfer your rights under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Provisions that by their nature should survive termination (including Sections 3, 6, and 8) will survive termination or expiration of these Terms.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
